Tianjin releases negative list for data transfer in free trade zone

The Administrative Committee of the China (Tianjin) Pilot Free Trade Zone and the Tianjin Municipal Bureau of Commerce on Thursday jointly released a negative list for cross-border data transfer, aiming to effectively ensure the safe and orderly cross-border data flows and promote China's high-level opening up.

This negative list is based on the "Enterprise Data Classification and Grading Standards in China (Tianjin) Pilot Free Trade Zone" that was issued in February this year. It focuses on addressing the needs of data transfer by enterprises in the pilot free trade zone and revolves around the development and regulatory requirements of eight key industries, including biomedicine, Internet platforms, automobiles, and international trade.

The list divides data into 13 major categories, such as strategic materials and bulk commodities, industry, finance, and science and technology. Each category is accompanied by detailed descriptions of the basic characteristics of the data to simplify comprehension and operational procedures for enterprises.

"For data that is not included in the negative list, we enable its unrestricted cross-border flow without the security assessment for outbound data transfer. The formulation of this negative list aims to create a new model in managing cross-border data transfer, ensuring that enterprises can conveniently, legally, and efficiently transfer data abroad. This initiative will further improve the business environment and enhance the international competitiveness of enterprises," said Liang Yiming, deputy director of the Administrative Committee of the China (Tianjin) Pilot Free Trade Zone.
