It was reported that Kacper's 21-year-old mother, Zaneta D, was with her boyfriend, Tomasz K, 22, on an outing to work in Radom, Central Poland. The son was left in the care of the 18-year-old babysitter, Adam B, and the clip was posted online by Mateusz S.

The police arrested Tomasz, Adam and Mateusz, and later released Mateusz. Adam and Tomasz may be charged with child abuse, and if found guilty, they may be sentenced to up to 10 years in prison.

During the investigation, it was discovered that Zaneta, the mother of Kacper, had a picture of her son being forced to smoke on her mobile phone. She claimed not to have knowledge of the picture's existence, insisting that she leaves her phone at home when she goes to work.
