Appeals court declines to block California from counting 20,000 disputed ballots

LOS ANGELES (AP) — An appeals court on Monday declined to rule on whether California elections officials can count roughly 20,000 ballots that the Justice Department alleges likely belong to noncitizen voters.

The 2-1 decision sets the Trump administration and state officials up for another legal showdown on the matter on Tuesday in front of a federal district judge, giving the federal government a very short window to compel California to sequester votes before the Nov. 3 elections.

The decision marks the latest in a string of legal setbacks for President Donald Trump’s administration as it seeks to assert greater federal control over state-run elections. Noncitizen voting has been a central focus of Trump’s political messaging for years, although available data indicates it is exceedingly rare.

Although the panel primarily ruled it was premature for an appeals court to get involved, two of the three judges also wrote separate concurrences making it clear they wouldn’t support setting aside ballots at this late date. They questioned the accuracy of the federal government’s list of alleged noncitizen voters and argued that to set aside votes risks disenfranchising citizens.

One judge dissented, arguing that federal law bars noncitizens from voting and compels California to vet the potentially illegal ballots before they are counted. The failure to do so, he wrote, would cause irreparable harm to the election.

The Republican administration sued election officials in the heavily Democratic state in mid-October, accusing them of failing to meet a 48-hour deadline to review a list of 20,000 people it alleged were likely noncitizens on the state’s voter rolls. The administration asked the judge to stop the state from counting those ballots until immigration status checks could be completed. The Justice Department made similar demands Monday in Washington, another state with races that will help determine control of the U.S. Senate and House.

Both state and federal law prohibit noncitizens from voting. But California officials say it’s not even clear the administration’s purported 20,000 noncitizen voters are actually not U.S. citizens. In court papers, Los Angeles election officials said the majority of a random sample of voters that the Department of Justice identified as immigrants seemed to have been born in the United States. The Justice Department, for its part, has said there is as much to lose from keeping the potentially illegal ballots in the count.

After a district judge had scheduled an Oct. 27 hearing on the issue, the federal government appealed to the 9th Circuit Court, arguing that a faster decision was needed to prevent the further counting of votes.

But two of the three 9th Circuit Court judges rejected that argument on Monday, writing that the federal government “failed to allow the district court adequate opportunity to consider” their initial request to sequester the ballots in question.

The time-sensitive emergency that the federal government used to justify the appeal, wrote Gabriel Sanchez, a circuit judge appointed by President Joe Biden, was at least in part “the product of the United States’s own decisions” to file so close to the elections, after votes had already started to get counted.

The federal government was delayed “in realizing that existing California state law governs the issuance and processing of ballots, in recognizing that California has millions of registered voters and processes ballots on a schedule aligned with that scale, and in communicating to the court its desired relief,” Sanchez wrote.

He wrote that setting aside the ballots at this stage “would transform California’s election rules for an election that is already underway” and “usher in electoral chaos.”

Judge Mark J. Bennett, who was nominated by Trump, also said that the federal government’s arguments weren’t supported by the law, writing that it appeared the administration had no power under the Constitution to force California to separate the ballots.

Judge Patrick Bumatay, who was appointed by Trump, forcefully dissented against the ruling. He argued that federal law precludes “California from commingling ballots likely cast by aliens with legitimate ballots, because it encourages and induces illegal voting. Stopping that practice for those identified as likely noncitizens is the bare minimum.”

Bumatay also affirmed the federal government's arguments about the need for an urgent ruling to sequester the ballots. While he conceded that the federal government could potentially prosecute fraudulent voters after the election, Bumatay said that the federal government “has an interest in stopping the illegal voting in the first place.”

California Attorney General Rob Bonta, a Democrat, hailed Monday’s ruling against the Republican administration as a “welcome speed bump to Trump’s disgusting attacks on the Constitution and our country’s democracy.”

In a statement, he urged voters to cast ballots early and “participate in democracy, don’t become disillusioned.”

The 9th Circuit decision sends the case back to a federal judge in Southern California, who will hear arguments from both sides on Tuesday at 1 pm.

Neither the Justice Department nor the Office of the U.S. Attorney in the Central District of California immediately responded to an emailed inquiry asking for comment.

LONDON (AP) — Harry Kane became the first Englishman in 25 years to win the Ballon d’Or on Monday thanks to his prolific scoring last season.

Kane scored 73 goals for club and country last campaign — he was Europe's top scorer — and smashed scoring records in Germany and at the World Cup, where he captained England to a third-place finish.

The Bayern Munich star says winning the prestigious individual award was built on so much more.

“Anything is possible with hard work, when no one else is watching, to go through the ups and downs, to learn through resilience, determination and self-belief,” an emotional Kane said in a message to young players, after reflecting on his early career struggles.

“My journey wasn’t straightforward. I wasn’t the kid who went straight to the top. I had to experience the downs,” he added. “I had to fight my way to be the very best right now. I hope that can give you inspiration as well.”

The 33-year-old Kane was followed in the voting by Kylian Mbappé, Lamine Yamal — voted best young talent for a third straight year — 2024 winner Rodri and record eight-time winner Lionel Messi.

Kane thanked his teammates, coaches, parents, children — “It's past your bedtime” — and wife Kate, “ my best friend. We’ve been through ups and downs for sure. You’re my biggest supporter. You always want the best for me.”

Kane led Bayern to the Bundesliga and German Cup double, scoring a hat trick against Stuttgart in the cup final.

At the World Cup, he scored six times to pass Gary Lineker as England’s all-time leading World Cup scorer and placed himself among the all-time top five in tournament history. His lineup lost to Argentina in the semifinals but beat Mbappé's France for third place, England's best World Cup placing in 60 years.

An Englishman hadn’t won the Ballon d’Or since Michael Owen in 2001.

“It's massive for England, for our country, (the ceremony) being here in London was a good omen for me,” Kane said. “It's been too long. Certainly (there have been) incredible English players... To put us back on the map, to put us here with this trophy I'm extremely proud. Playing for England is my biggest honor, the thing I love to do the most.”

England coach Thomas Tuchel tole Kane the Three Lions are “lucky to have you as our leader.”

“I ran out of superlatives to describe your performances a long time ago, but I’m delighted to see that you have now been formally recognized by the football world,” Tuchel said.

Fans packed the streets and climbed light poles near the London Palladium, where the event was held, for a glimpse of the arriving athletes. Kane stopped to sign autographs on his way in.

They stayed through the ceremony and chanted Kane's name as he left the theater near Oxford Circus after midnight.

Kane planned to celebrate with family and friends, but just a little.

“We have a cup game on Wednesday so it can't get too messy,” Kane said, noting he has an early Tuesday flight back to Munich in time for team training.

Monday’s ceremony was held in London for the first time in recognition of the inaugural winner 70 years ago, England’s Stanley Matthews in 1956.

Earlier, Spain star Alexia Putellas won her third women’s Ballon d’Or after leading her former club Barcelona to multiple trophies last season including the Women’s Champions League.

Putellas, who joined London City Lionesses in the offseason, also helped Spain win the Women’s Nations League last December.

The 32-year-old midfielder ended Spain teammate Aitana Bonmati’s three-year reign.

Putellas won the prestigious award in 2021 and 2022, tore her ACL and saw Bonmati rise to stardom. Bonmati, who completed her women’s Ballon d’Or three-peat in 2025, was not on this year’s shortlist after breaking her leg in December.

Putellas urged young boys and girls to approach the sport with “love and passion.”

“Believe in yourself, that’s the most important thing,” she said. “If you have a dream, go for it, even if at some point you have to start from zero.”

Putellas had joined Barcelona in 2012 and called her time at the Catalan club “something special.”

“I'm really grateful for having 14 seasons as a player (at Barcelona),” she said. “What I experienced last year was like a perfect story.”
