Los Angeles trial attorney Christopher Montes de Oca secured a $45 million trial settlement on behalf of a woman who suffered catastrophic brain injuries after she and her son were struck by a FlyAway airport shuttle bus while crossing a marked crosswalk in Los Angeles.

The case was tried in Los Angeles County Superior Court in Armida Lincome and Christofer Bishop v. Four-Season Travel LLC, Douglas Herrera, 9139249 Canada Inc., Bus.com US LLC, Bus.com Leasing LLC, and the City of Los Angeles.

According to evidence presented at trial, the crash occurred on August 3, 2023, when Armida Lincome, 58, and her son, Christofer Bishop, 29, were crossing a marked crosswalk when they were struck by a FlyAway airport shuttle bus operated by Douglas Herrera. The lawsuit alleged the driver made an unsafe left turn and failed to yield to pedestrians who had the right of way and an active walk signal.

Lincome suffered severe injuries including a traumatic brain injury and subdural hematoma. She was initially rendered comatose and later remained in a minimally conscious state.

Bishop was also struck in the incident and sustained head and facial injuries. He sought damages for the emotional distress of witnessing his mother suffer catastrophic injuries.

The lawsuit alleged negligence against the shuttle driver and vicarious liability against his employer, Four-Season Travel LLC. Claims were also asserted against the City of Los Angeles and contractors involved in operating the airport shuttle service.

“The City of Los Angeles could not avoid liability because operating the airport shuttle is a nondelegable duty,” said attorney Christopher Montes de Oca, counsel for the plaintiffs.

After the plaintiffs presented their evidence and rested their case, the matter resolved during trial shortly before closing arguments on March 4, 2025, through a mediated settlement totaling $45 million.

Approximately $40 million was paid by insurers for the City of Los Angeles, while $5 million was paid by insurers for Four-Season Travel LLC and the driver.

Montes de Oca served as lead trial counsel for the plaintiffs.
