China Enacts Regulations on Countering Foreign Inappropriate Extraterritorial Jurisdiction to Strongly Counter Long-arm Jurisdiction and Protect Rights and Interests with Improved Legal Tools
China has officially promulgated the Regulations on Countering Foreign Inappropriate Extraterritorial Jurisdiction, which consist of 20 articles. The regulations clarify three core aspects: defining the scope of application and working mechanism; establishing a system for identifying, blocking and countering foreign inappropriate extraterritorial jurisdiction measures; and improving the service and guarantee system. It explicitly stipulates that the Chinese government has the right to exercise extraterritorial jurisdiction over acts having a proper connection with China, and specifies counter and restrictive measures to be adopted at the national level. Notably, the regulations pioneer an enforcement prohibition order system and set up a malicious entity list system, with clear provisions on relevant procedures, applicable measures and exemption rules.
Safeguarding national sovereignty, security and development interests is an unchallengeable bottom line for every sovereign state. The enforcement prohibition order system, in particular, forbids any organization or individual from executing or assisting in executing foreign inappropriate measures, cutting off the transmission path of unwarranted external interference from the source.
The malicious entity list system equips China with powerful legal tools to target malicious promoters and participants, with specific countermeasures including visa refusal, revocation of entry qualifications, seizure, detention and freezing of assets in China, and restrictions on trade and investment activities.
